CIVIC ACCESS.

The right to civic access consists in the possibility for citizens to access data, documents and information held by public administrations or public service concessionaires.

Such right concerns both data that are subject to mandatory publication (where the same data are not published) and any other data (in the latter case within the limits provided by law to protect other public and/or private interests: article 5 bis of Legislative Decree No. 33/2013).

Health facilities accredited and under contract with the Regional Health Service are subject to the right of civic access in relation only to data, documents and information concerning the performance of health care activities. The request must enable the structure to identify the data, document or information it intends to acquire; generic requests are therefore inadmissible.
In the case of a request relating to a manifestly unreasonable number of documents, such as to impose a workload likely to jeopardise the proper functioning of the healthcare facility, the latter may reject it in order to protect the proper performance of the administrative activity (National Anti-Corruption Agency-Anac Guidelines on Generalised Civic Access, paragraph 4.2).
